These terms apply between andQFIVE Coaching GmbH, Hoher Markt 4/20, A-1010 Vienna ("Mocaia", "we") and anyone who uses mocaia.com or books coaching through it: companies that commission coaching ("clients") and the people who are coached ("coachees"). For corporate clients, the individual contract takes precedence.

Mocaia selects, presents and matches coaches and organises the booking of sessions. Coaching is delivered by independent coaches who act in their own professional responsibility. Coaching is not therapy and does not replace medical or psychological treatment.

Booking requires a Mocaia ID account. You must provide accurate details and keep your sign-in secure.

Discovery Calls are free, non-binding introductory conversations. To keep them fair for everyone, a coachee can book at most three Discovery Calls within any three-month period, and at most one with the same coach in that period. Cancelled calls do not count.

Coaching sessions are booked under a contract that defines the coach, the number of sessions and the period in which they can be used. Sessions not booked or used within that period lapse unless agreed otherwise.

You can reschedule or cancel a session free of charge up to 48 hours before it starts. Changes within 48 hours are treated as a late change: the session may count as used, unless the coach agrees otherwise. A session you miss without notice counts as used (no-show). If a coach cancels, the session is not counted.

If you book as a consumer, you may withdraw from a contract concluded online within 14 days without giving reasons. The period starts on the day the contract is concluded. To withdraw, send us a clear statement (e.g. by email to hello@mocaia.com). It is enough to send it before the period ends.

If you ask us to start sessions before the withdrawal period ends, you must pay a proportionate amount for the sessions already delivered when you withdraw. Once all services have been fully delivered at your express request, the right of withdrawal expires.

Coaches treat everything discussed in sessions as confidential. Details of how we handle personal data are in our privacy policy.

We are liable for intent and gross negligence. For slight negligence we are liable only for personal injury. These limits do not apply where mandatory consumer protection law provides otherwise. We do not guarantee a particular coaching outcome.

We may change these terms with reasonable notice by email. Changes do not affect bookings already confirmed.

Austrian law applies, excluding its conflict-of-law rules and the UN Sales Convention. The place of jurisdiction for businesses is Vienna. Consumers keep the protection of the mandatory law and courts of their place of residence.
